PAYE is a tax charged on income of individuals, both Resident and Non-resident, in gainful employment. Refund arises in cases where an employer fails to grant relief which is due to an employee, e.g. personal relief or insurance relief. It can also arise where the tax deducted at source is more than the final liability. A claim for refund must be made within 5 years of the date the tax was paid. A decision on the application shall be communicated to the taxpayer within 90 days of receiving the application by the Commissioner.
