A person who disputes the decision of the Commissioner on any matter arising under the provisions of any tax law may, subject to the provision of the relevant tax law, upon giving notice in writing to the Commissioner, appeal to the Tribunal, provided that such person shall before appealing, pay a non- refundable fee of Ksh 20,000.
A notice of appeal to the Tribunal pertaining to an assessment is legitimate if the taxpayer has paid the tax not in dispute or has made an agreement with the Commissioner to offset the tax not in dispute under the assessment at the time the notice is lodged.
