Customs Duty Refund Application

Custom duty is a tax imposed on goods brought into Kenya. Duties are assessed based on the customs value of the item i.e. based on the price actually paid or payable for the imported goods. Refund claim should be lodged within 12 months from the date of payment of the duty. A decision on the application shall be communicated to the taxpayer within two months of receiving the application.


It applies to registered persons who have made payment of duty on importation of goods which; -

i. Have been damaged or pillaged during the voyage or while subject to Customs control;

ii. Import/export duty has been paid in error; and

iii. An order remitting such duty has been made under the EACCMA.
